These Terms & Conditions govern your access to and use of the Shelter Nepal mobile application, website and related services, collectively referred to as the "Services".
The Services are operated by Shelter Nepal, referred to in these Terms as "Shelter Nepal", "we", "us" or "our".
By creating an account, publishing a property listing, submitting an enquiry or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.
Eligibility
You must be legally capable of entering into a binding agreement under applicable law to create an account or use Shelter Nepal for property-related transactions.
If you use the Services on behalf of a company, property agency, organisation or another person, you confirm that you have authority to accept these Terms on their behalf.
The Services are not intended for children under 13 years of age.
Account registration and security
Some features require you to create an account. You agree to provide accurate, complete and current information during registration and to keep that information updated.
You are responsible for:
- Keeping your password, verification codes and account credentials confidential.
- All activity performed through your account.
- Ensuring that your registered email address and phone number remain accessible and accurate.
- Informing us promptly if you suspect unauthorised access or misuse of your account.
You must not create an account using false information, impersonate another person or transfer your account to another person without our permission.
Shelter Nepal’s role
Shelter Nepal provides an online property marketplace where property owners, landlords, agents, buyers, tenants and other users can publish listings, discover properties, communicate and submit enquiries.
Unless expressly stated otherwise, Shelter Nepal:
- Does not own, rent, sell, manage or control properties listed by users.
- Is not a landlord, tenant, buyer, seller, agent, broker or party to agreements made between users.
- Does not guarantee the identity, authority, conduct or reliability of any user.
- Does not guarantee the accuracy, legality, availability, ownership, condition, price or quality of any property.
- Does not guarantee that a transaction, rental, sale or enquiry will be completed.
Any agreement, payment, property inspection, rental, purchase or other transaction is made directly between the users involved.
Property listings and user content
Users who publish listings or other content are solely responsible for that content.
By publishing a listing, you confirm that:
- You own the property or have valid authority from the owner to advertise it.
- The property title, price, location, availability, facilities, photographs and description are accurate.
- The listing does not violate any law, contract, ownership right or third-party right.
- You will update or remove the listing when the property is no longer available.
- You have permission to upload and publish all photographs, videos, documents and other content included in the listing.
You must not publish false, misleading, duplicate, fraudulent, expired or unauthorised listings.
Licence to use submitted content
You retain ownership of content you submit to Shelter Nepal. However, by uploading or publishing content, you grant us a non-exclusive, worldwide, royalty-free and transferable licence to host, store, reproduce, display, format, resize, distribute and use that content as necessary to operate, promote and improve the Services.
This licence allows us to display your listings and related content through the mobile application, website, search results, notifications, promotional materials and supported third-party channels.
You confirm that granting this licence does not violate the rights of any person or organisation.
User communications
Shelter Nepal may allow users to contact landlords, owners, agents, buyers or tenants through enquiries, phone calls, email, messaging or other communication tools.
You agree to use contact information only for genuine property-related communication. You must not:
- Send spam, unsolicited advertising or unrelated promotional messages.
- Harass, threaten, deceive or abuse another user.
- Collect, publish or misuse another user’s personal information.
- Use contact details for purposes unrelated to the relevant property enquiry or transaction.
Users are responsible for independently verifying the identity and authority of any person they communicate with.
Property verification and safety
We may review listings, request information, mark certain accounts or listings as verified, or remove content that appears suspicious or violates these Terms.
Verification does not represent a guarantee, certification or warranty regarding a user, property, document, transaction or listing.
Before making a payment or entering into an agreement, users should:
- Inspect the property personally or through a trusted representative.
- Verify property ownership and the authority of the landlord, owner or agent.
- Review relevant legal, ownership and property documents.
- Use written agreements and retain payment records.
- Obtain independent legal, financial or professional advice where appropriate.
Users should not transfer money solely because a listing or profile appears on Shelter Nepal.
Prohibited conduct
You must not use the Services to:
- Publish fraudulent, misleading, unlawful or discriminatory content.
- List a property without the owner’s permission.
- Impersonate another person, company, landlord, owner or agent.
- Request or collect payments through deception, misrepresentation or fraudulent activity.
- Upload malware, harmful code or content intended to damage the Services.
- Attempt to gain unauthorised access to accounts, systems, servers or data.
- Scrape, crawl, copy, harvest or extract data through automated means without written permission.
- Reverse-engineer, decompile, modify or interfere with the Services.
- Circumvent security, moderation, access controls or usage restrictions.
- Infringe copyrights, trademarks, privacy rights or other legal rights.
- Use the Services for any purpose that violates applicable law.
Listing moderation and removal
We may review, reject, suspend, edit, restrict or remove a listing, profile or other content when we reasonably believe that it:
- Violates these Terms or applicable law.
- Is false, misleading, duplicate, expired or fraudulent.
- Infringes another person’s rights.
- Creates a risk to users, Shelter Nepal or the public.
- Is technically harmful or disrupts the Services.
We are not obligated to monitor every listing, communication or item of user content before it is published.
Fees and paid features
Downloading the application, creating an account and browsing listings may be free unless otherwise stated.
We may offer optional paid services, including promoted listings, featured placements, subscription plans, advertising or other premium features.
The price, duration, features, payment terms and applicable taxes will be shown before you purchase a paid service.
Payments made through Google Play, Apple’s App Store or another payment provider may also be governed by that provider’s terms, billing rules and refund policies.
Subscriptions and automatic renewal
If Shelter Nepal offers a recurring subscription, the subscription terms, billing frequency and price will be shown before confirmation.
Subscriptions purchased through Google Play or Apple’s App Store may renew automatically unless cancelled through the relevant store account before the renewal date.
Uninstalling the Shelter Nepal application does not automatically cancel an active subscription.
This section applies only where subscription services are offered.
Refunds
Unless required by applicable law, fees paid directly to Shelter Nepal are generally non-refundable after the relevant paid feature has been activated or delivered.
Refund requests for purchases processed by Google Play, Apple’s App Store or another payment provider must normally be submitted through that provider and will be subject to its refund rules.
Nothing in these Terms limits any mandatory refund or consumer right available under applicable law.
Third-party services and links
The Services may contain links to or integrations with third-party websites, maps, payment services, telephone services, messaging platforms, advertisements or other tools.
Shelter Nepal does not control and is not responsible for the availability, security, content, products, services or privacy practices of third parties.
Your use of third-party services is governed by the relevant third party’s own terms and policies.
Intellectual property rights
The Shelter Nepal name, logo, brand, application, website, interface, software, design, database, text, graphics and other materials provided by us are owned by or licensed to Shelter Nepal and are protected by applicable intellectual property laws.
Except as permitted by law or authorised by us in writing, you may not copy, reproduce, modify, distribute, sell, licence, publish or commercially exploit our intellectual property.
Account suspension and termination
We may warn, restrict, suspend or terminate an account or access to the Services if we reasonably believe that a user:
- Has violated these Terms or applicable law.
- Has engaged in fraud, abuse, harassment or unsafe conduct.
- Has published false or unauthorised property listings.
- Creates legal, security or reputational risk.
- Has repeatedly received valid complaints from other users.
Where appropriate, we may remove related listings or content and prevent the creation of replacement accounts.
Closing or deleting your account
You may request closure and deletion of your Shelter Nepal account by contacting our administrative team at shelternepal01@gmail.com.
Send the request using the email address registered with your account and include your full name, registered email address or phone number, and a clear request to delete the account.
We may verify your identity before processing the request. Certain information may be retained where required for legal compliance, fraud prevention, security, dispute resolution or legal claims.
Uninstalling the application does not automatically close or delete your account.
Availability and changes to the Services
We may modify, update, suspend, restrict or discontinue any part of the Services at any time.
We do not guarantee that the Services will always be available, uninterrupted, secure or error-free. Access may be interrupted because of maintenance, updates, technical failures, network issues or events outside our control.
Disclaimer of warranties
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.
Shelter Nepal does not provide warranties or guarantees regarding:
- The accuracy or completeness of listings or user content.
- The condition, ownership, legality or availability of a property.
- The identity, authority or conduct of users.
- The outcome of an enquiry, negotiation, rental or sale.
- Continuous, uninterrupted or error-free operation.
Limitation of liability
To the maximum extent permitted by applicable law, Shelter Nepal and its directors, employees, contractors and service providers will not be liable for indirect, incidental, special, consequential or punitive losses arising from your use of the Services.
This includes losses arising from:
- Property listings or content submitted by users.
- Rental, sale, deposit, payment or other transactions between users.
- Fraud, misrepresentation or misconduct by another user.
- Property defects, ownership disputes or legal issues.
- Loss of data, profit, opportunity, goodwill or business.
- Unavailability, interruption or technical failure of the Services.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
Indemnity
To the extent permitted by law, you agree to indemnify and hold Shelter Nepal harmless from claims, losses, damages, liabilities and reasonable expenses arising from:
- Your use or misuse of the Services.
- Content or property listings you publish.
- Your violation of these Terms or applicable law.
- Your infringement of another person’s rights.
- A property transaction, dispute or agreement involving you.
Privacy
Our collection and use of personal information are governed by our Privacy Policy.
By using the Services, you acknowledge that you have read the Privacy Policy and understand how information is collected, used, shared and retained.
Changes to these Terms
We may update these Terms to reflect changes to the Services, business practices, legal requirements or platform features.
When changes are made, we will update the effective date at the top of this page. For material changes, we may provide notice through the application, website, email or another reasonable method.
Continued use of the Services after updated Terms become effective means that you accept the revised Terms.
Governing law and dispute resolution
These Terms are governed by the applicable laws of Nepal, without regard to conflict-of-law principles.
Users should first contact Shelter Nepal and attempt to resolve any complaint or dispute informally.
If a dispute cannot be resolved informally, it will be subject to the jurisdiction of the competent courts of Kathmandu, Nepal, unless applicable law requires otherwise.
General provisions
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
Our failure to enforce a provision does not waive our right to enforce it later.
You may not transfer your rights or obligations under these Terms without our written permission. We may transfer our rights and obligations as part of a merger, restructuring, financing, acquisition or business transfer.
These Terms, together with the Privacy Policy and any additional terms displayed for specific features, constitute the agreement between you and Shelter Nepal regarding the Services.
